A PERMIT IS REQUIRED FOR MOST TYPES OF ENCROACHMENT INTO THE WRD EASEMENT OR RIGHT-OF-WAY
EASEMENT: An easement is a non-possessory interest in real property. An easement is the right to use or control property, and/or an area above or below it, for a specific limited purpose.
RIGHT-OF-WAY: A right-of-way is the right to pass through property owned by another. A right-of-way may be held as fee title or may be in the nature of an easement.
ENCROACHMENT: an interference with or intrusion in to another’s property. Anything or conduct that created an interference with an easement or right-of-way is considered an encroachment. Encroachments can be described as a structure or thing that creates an interference of any degree with the use, maintenance, or operation of a WRD facility.
INTERFERENCE: The act or process of interfering, something that interferes, obstruction, to interpose in a manner that hinders or impedes the reasonably convenient use of an easement or right-of-way.
FENCES / RETAINING WALLS
- It is imperative to preserve the integrity of the canal and tow of the slope. Therefore, fence and retaining wall placement must be approved by District management.
- Please have your proposed fence line or retaining wall staked or marked prior to scheduling your site visit.
LANDSCAPE
- No trees planted within 10′ of canal liner or road.
- Shallow rooted plants and bushes (30-inch maximum root growth within 5′ of canal liner is acceptable).
- The Permittee, its successors and assigns, is responsible for the trimming of foliage, trees, etc. which impinge upon the District’s right-of-way / easement.
PROCEDURE AND COST ASSOCIATED WITH PERMIT
- Schedule an appointment with management for a site visit. Remember to have your proposed fence line or retaining wall staked or marked.
- If approved, you must prepare a site plan for recording.
- Schedule an appointment with the office staff for permit signature(s).
- Permit fee $50.00 check made payable to Wenatchee Reclamation District.
- Recording fee, usually between $205-$210 depending upon number of pages to be recorded. Please make check made payableto the county auditor.
- Once the document is recorded, a copy will be mailed for your records.
